Terms and conditions

The purpose of the said general conditions of use (hereinafter referred to as "Terms and Conditions") is to provide alegal framework for the terms and conditions under which the « Site » is made available by Laboratories Mayoly Spindler and to determine the conditions ofuse and access by the « User » to the Site.

The User acknowledges that he/she has read and fully accepts all of the said Terms and Conditions, without restriction or reservation, by ticking the matching box when register on the Site.

In the case of non-acceptance of the said Terms and Conditions, the User will not be allowed to access to the services offered by the Site.

Laboratories Mayoly Spindler, may modify the terms of the said Terms and Conditions, at anytime.
The User is invited to regularly consult the said Terms and Conditions, which are permanently available on the Site, in order to take note of the changes made to them.

The Mayoly website is published by Laboratories Mayoly Spindler, with share capital of 775 000 €  euros, Registered in Versailles  under  number B 709 807 408  with its registered office at 6 avenue de l’Europe, 78400 Chatou.

The design and development of the Site are ensured by the LEAD-UP Network, SAS with a capital of 50 000 € whose registered office is located at 104 bd du Montparnasse, 75014 Paris, France.

The Site is hosted by SCRIIPT, SAS with a capital of 50 000 € whose registered office is located at 46D Rue Louis Kerautret Botmel, 35200 Rennes, France.

"User"  or  "Users"  means  any  individual  person  acting  as  a  health  care  professional  and/or  any  employee  of  Laboratories  Mayoly  Spindler  who  has  an  account  provided  by  Laboratories  Mayoly  Spindler, enabling him/her to access to the Site.

"Username and Password": all the information required to allow User to access to their account. The Username and password are created by the User and are confidential.

« Site »: platform gathering all the MayolyLIVE medical education contents in the field of gastroenterology, through Live and Replay events built in collaboration with international experts, available on the link (www.mayolylive.com) and to which the Users have access.

The access to the Site is free of charge and User(s) have access once created its accounts directly into the Site and having its Password and Username.

Laboratories Mayoly Spindler uses all the means at his disposal to ensure quality access to its services. This obligation is an obligation of means and not of result. Access to the Site’s services may be interrupted, suspended or modified at any time without notice for maintenance or any other reason. The User undertakes do not claim any compensation following these disruptions.

The  User(s)  is  responsible  for  the  veracity  of  all  information  he/she  provided  to  the  Site  and/or  to  Laboratories Mayoly Spindler.

Regarding the process of its personal data, the User(s) shall consult our privacy policy, accessible on the Site under Privacy Policy Section.

In case of false declaration and/or non-compliance with the Terms and Conditions, Mayoly reserve the right  to  exercise  any  action  and/or  sanction  it  deems  necessary  towards the  User  concerned  and  in particular those described in paragraph 7 and, the User concerned bear full responsibility of its acts and shall indemnify Mayoly against any damages resulting from it.

In the case of the use of a board or chat space for virtual discussion, the User undertakes to:
- Compose objective and never excessive or insulting comments;
- Do not denigrate or participate in the denigration or in the promotion of a company, health products, pharmaceutical know-how;
- More  generally,  avoid  any  unlawful  practice,  unfair  behavior  or  act  which  contravene  the code of ethics for health professionals;
- Do not identify, directly or indirectly, an individual person;
- Do  not  record  data  considered  sensitive  (racial  or  ethnic  origin,  political,  philosophical,  or  religious  opinions,  trade  union  membership,  data  relating  to  health  or  sex  life,  offences,  convictions, security measures).

Laboratories Mayoly Spindler declines all responsibility for the content of the comments or messages entered by the User(s).

The User undertakes to take all precautions in accordance with the customs and state of art, in order to protect the scientific merit and integrity of the information accessible via the Site and in particular to prevent it from being modified, damaged or misused.

In particular, the User(s) undertakes;
- not to use the information and data to which he has access for purposes other than those initially determined for the Site.
- ensure that there is no misappropriation or fraudulent use of this information.
- not to make any copies of this information and data, except if it is expressly permitted by the Site.

The  trademarks,  logos,  signs,  and  any  other  content  of  the  Site  are  protected  by  the  Intellectual  Property Code and more particularly by copyright.
The www.mayolylive.com website is the exclusive property of Laboratories Mayoly Spindler. In accordance with intellectual property rights, this Site and all the elements contained therein (works of any kind, trademarks, drawings, models, graphics, Video, etc.) as well as their compilation are the exclusive property of Laboratories Mayoly Spindler.
Any reproduction and/or representation, in whole or in part, of the Site, or of any of its components, on any medium whatsoever, for other purposes, and in particular commercial purposes, by the User, is,  in  accordance  with  the  provisions  of  article  L122-4  of  the  Intellectual  Property  Code,  prohibited  without the express prior consent of its author.

The  User  is  responsible  for  keeping  its  password  secret.  Any  disclosure of  its  password,  in any  form  whatsoever, is prohibited.
The User assumes the risks associated with the use of his/her login and password. Laboratories Mayoly Spindler declines all responsibility.
The User is responsible for any act that he/she commits and resulting damage for Laboratories Mayoly Spindler. The User is responsible for the obligations incumbent on him/her under the present Terms and Conditions and undertakes to perform them in accordance with the Terms and Conditions.
In case of any action against laboratories Mayoly Spindler as a result of use by a User which does not comply with these Terms and Conditions, the said User undertakes to intervene in the dispute and to reimburse  laboratories Mayoly  Spindler for  any  sum that  laboratories  Mayoly  Spindler  may  have  to  pay (damages, legal fees, etc.).

Laboratories Mayoly  Spindler also  reserves  the  right to take  any measure  against  a User  due  to the  latter's failure to comply with the provisions of these Terms and Conditions. In particular;

  • immediate, temporary or permanent withdrawal of;
        a) User(s)’s right to use the Site (including our Forums) and/or
        b) of User Generated Content posted by him/her to the Site;
  • issue of a warning to him/her;
  • further action against User for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.

These  Terms  shall  be  governed  by,  and  construed  in  accordance  with,  French  Law.  You  irrevocably  agree that the courts of France shall have exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with these Terms or the legal relationship established by them, and for those purposes irrevocably submit all disputes to the jurisdiction of the French courts.
